Terms of service

These terms govern the use of michibinder.com and the subscription to Michi Pro. Creating an account means accepting them. They are written in French law, and the French version prevails in case of discrepancy.
1.Publisher and seller

Prices are stated in euros, VAT not applicable under article 293 B of the French tax code.
2.What the service does
Michi Binder lets you lay out binder pages, place cards from a public catalogue, add your own artwork, preview the result and export a print-ready PDF of the artwork. A free plan is available without any payment card. Michi Pro adds capacity, every page format and collaborative editing.
The card catalogue comes from third-party sources and may be incomplete or wrong. Prices shown are indicative, come from third parties, and are neither an offer nor a valuation.
3.Your account
An account requires a valid email address and a password, or a Google or Discord account. You are responsible for keeping your credentials safe and for what happens under your account. One person, one account.
Accounts are not open to children under 15 without the agreement of a parent or guardian.
4.What you put in it
What you compose and upload stays yours. You grant only the permission needed to run the service: storing your files, displaying them to you, and to whoever you choose to share them with.
You warrant that you hold the rights to the images you upload, or that their use is permitted. Uploading artwork you have no right to use, or content that is unlawful, violent, hateful or infringing, is forbidden and may lead to the removal of the content and the closing of the account.
Michi Binder is an independent project, not affiliated with, endorsed by or sponsored by Pokémon, Nintendo, Game Freak or The Pokémon Company. Names, trademarks and artwork belong to their respective owners. The service is meant for private use of your own collection.
5.Michi Pro subscription
The subscription runs monthly, renews automatically, and is paid through Stripe. The price shown when you subscribe is the price you pay, including any applicable tax; a later change of price does not apply to running subscriptions.
You may cancel at any time from your subscription page. Cancelling stops renewal: Pro stays active until the end of the period already paid, which is not refunded on a pro rata basis. Nothing is deleted when it ends; free limits then apply to new creations.
Failure to pay suspends the paid features until payment is made. Fraud or abuse may lead to immediate suspension.
6.Right of withdrawal
As a consumer you have 14 days to withdraw from the subscription. Because the service is supplied immediately, you are asked at checkout to request that immediate performance begins and to acknowledge that you lose your right of withdrawal once the service has been fully supplied, as provided by article L221-28 of the French consumer code. Without that request, performance starts after the 14 days.
To withdraw within the period, write to contact@michibinder.com. Any amount due is refunded within 14 days by the same means of payment.
7.Availability
The service is provided as it stands, with the care of a small independent project. No level of availability is guaranteed: maintenance, an outage at a provider or a defect may interrupt it. Features may change or disappear, and a change that removes something substantial is announced to subscribers beforehand.
Keep your own copies of anything that matters to you. Export of your artwork as PDF is available on every plan.
8.Liability
Liability is limited to direct damage, and to the amount paid over the twelve months preceding the event. Nothing here limits liability for death, personal injury, gross negligence or wilful misconduct, nor the statutory guarantees owed to consumers.
9.Ending the relationship
You may close your account at any time by writing to us. We may suspend or close an account that breaches these terms, after notice where the breach allows it, and immediately where it does not.
10.Personal data
The processing of your personal data is described in the privacy policy, which forms part of these terms.
11.Disputes
Any complaint should first be sent to us, so that a solution can be found.
A consumer mediator will be named here before paid subscriptions open, as French consumer law requires.
These terms are governed by French law. Nothing deprives a consumer of the protection afforded by the mandatory rules of the country where they live.
12.Changes to these terms
These terms may change. Subscribers are told by email before a change takes effect, and may cancel if they do not accept it. The version in force is the one published here on the day of your order.
